Stradini Hospital Executed Court Decision and Paid Former Board Members

In response to a question about whether the paid amounts create a significant burden on the hospital's budget, a representative of PSKUS explained that potential scenarios for the development of the court process were assessed during budget planning, and financial resources were allocated for such an outcome. As reported, the Supreme Court refused to initiate cassation proceedings on the lawsuit of three former PSKUS board members regarding severance payments, resulting in the enforcement of a decision obligating the hospital to pay them benefits totaling 38,872 euros, said the plaintiffs' lawyer Kristaps Loze. The hospital is also ordered to cover court and attorney fees. Rinalds Muciņš is to receive a severance payment of 16,000 euros and 1,724.25 euros for attorney services, Agra Melne is to receive 11,486 euros in severance and 1,724.25 euros for attorney fees, and Jānis Naglis is to receive 11,486 euros in severance and 1,724.25 euros for attorney fees. In total, the hospital must pay the board members 44,144.75 euros. Additionally, the hospital must pay a state duty of 2,124.15 euros. The Supreme Court indicated that the PSKUS council dismissed the former board members based on a subjective criterion—loss of trust—without specific evidence of violations of their powers, failure to fulfill duties, or causing harm to the interests of PSKUS. The court did not establish that the former board members violated their powers, failed to fulfill or improperly fulfilled their duties, or caused harm to the interests of PSKUS, and also noted that there is no evidence in the case that the plaintiffs acted in bad faith or recklessly. The court also emphasized that the documents prepared later at the request of PSKUS—audits and legal opinions—did not reveal any improper performance of duties by the board members and cannot be used retroactively as grounds for their dismissal. Former PSKUS chairman Rinalds Muciņš stated that this decision confirms that the dismissal of board members should be based on objective and provable circumstances, not on subjective feelings. Muciņš explained that the court showed that the former board members acted in accordance with the law and the interests of the hospital, and this decision restores justice for both them and ensures that transparent, professional, and evidence-based decisions prevail in the management of state enterprises. Last year, PSKUS planned to appeal the decision of the Riga Regional Court, as after its assessment, the hospital concluded that there were no grounds to agree with its reasoning and final conclusions. According to PSKUS, the court only gave weight to evidence concerning the performance of duties by the board members, but the decision did not explain why evidence indicating improper performance of duties by the previous board in managing the risks of constructing building A2 was not taken into account. Regulatory provisions stipulate that in the case of such improper performance of duties, severance pay is not paid to a board member, the hospital notes. As reported, the difference between the decision of the Riga Regional Court and the decision of the first instance court concerned Ilze Kreitzberga, as her contract did not provide for the right to receive severance pay. Therefore, the claim for the recovery of benefits in her favor was dismissed, and she is to be charged the state duty. At the same time, the claims of Muciņš, Jānis Naglis, and Agra Melne were satisfied—PSKUS was ordered to pay them the severance benefits due, as well as the costs for the assistance of a legal counsel. Additionally, the appellate court clarified the amount of state duty that the hospital must transfer to the state budget, as the first instance court applied incorrect regulations. In 2024, a new board of PSKUS was approved, headed by the former interim head of the institution, Lauris Vidzis. The medical direction in the board is overseen by pulmonologist Dace Jentinja, while financial management is handled by Girts Ansons. The PSKUS council expressed no confidence in the previous board of the hospital at the end of October 2023, dismissing Muciņš, Kreitzberga, Naglis, and Melne from their positions. This occurred in connection with failures in the construction of the new building A2 of PSKUS. The facility was built by SIA Velve, but it was not completed, and the contract with the contractor was terminated.
