In Lower Saxony, a decision has been made in the high-profile case regarding the death of a 16-year-old girl from Ukraine in 2025, who was pushed under a freight train by an illegal migrant from Iraq. On Wednesday, April 29, the regional court in Göttingen ordered psychiatric treatment for the accused. In making the decision, the judge took into account the results of an examination, during which paranoid schizophrenia was diagnosed in the 31-year-old Iraqi refugee. The court found it proven that in the summer of 2025, he pushed the girl at the Friedland train station under an oncoming freight train, and she died on the spot. The Iraqi refugee should not have been in Germany The case concerning the girl's death, who fled to Germany with her family from the war in Ukraine in 2022, led to extensive public and political debates in Germany about migration issues. According to European asylum regulations, the Iraqi national had no right to be in Germany. A few months before the crime, he was supposed to be sent to Lithuania, through which he entered the EU. The regional refugee reception office had requested the detention of the Iraqi national pending his deportation, but the request was rejected by an administrative court in Hanover. ## The Accused Was Found Dangerous to Society The Göttingen prosecutor's office, in light of the accused's diagnosis, argued that he was in an insane state at the time of the act. Therefore, instead of a regular criminal trial and charges, a procedure was conducted to establish the perpetrator of the crime, and a decision was made regarding his psychiatric treatment. Despite the limited capacity of the accused, the prosecution stated in the indictment that it was a case of intentional murder. Furthermore, the prosecution deemed the defendant dangerous to society.
