The Ministry of Justice believes that the legal regulation of the state of emergency in Latvia needs significant updating. The relevant proposals are outlined in a press release published on the Legal Acts Portal. The ministry points out that currently the Satversme only regulates the state of emergency, while provisions regarding the state of emergency are absent from the Constitution. According to the Ministry of Justice, this creates legal gaps that may complicate the work of state authorities during crises and large-scale disasters. Therefore, the ministry proposes to enshrine in the Satversme what powers the Saeima and the Cabinet of Ministers have in such situations, how parliamentary oversight should be conducted, and in what exceptional cases the government will be able to adopt regulations that have the force of law. At the same time, it is proposed to limit such powers with clear legal frameworks. In fact, this is about pre-defining the rules of state action in crisis conditions, rather than making decisions during the emergency itself. The Ministry of Justice also proposes to assess the possibility of granting the Constitutional Court the right to consider decisions made during the state of emergency in an expedited manner. In addition, it is proposed to clarify the constitutional grounds for possible restrictions on fundamental rights and to review the provisions on administrative liability for violations of existing restrictions. Another proposal concerns the duration of the special regime. The ministry believes that the current procedure, which allows the Cabinet of Ministers to repeatedly extend the state of emergency, needs to be revised, as prolonged extensions may dilute the very idea of this temporary legal regime. The ministry emphasizes that the current legislation generally allows state institutions to respond to crises. However, it is not always the optimal legal basis, especially if the Saeima cannot convene for a meeting promptly for objective reasons. Discussions on possible changes will continue. If deemed necessary, by December next year, the Ministry of Justice will prepare and present to the government a draft amendment to the Satversme and related laws.
