The head of the conservative CDU/CSU faction in the Bundestag, Jens Spahn, announced his resignation on Saturday. The decision followed several days of intense criticism sparked by reports that he and his spouse became parents through a surrogate mother in the United States. German Chancellor Friedrich Merz, also representing the Christian Democratic Union, supported the politician's decision. According to him, the resignation was "the right and inevitable" choice, as trust remains the main capital of any politician. The scandal was not caused by the birth of the child itself, but by the contradiction between Spahn's personal action and his long-standing public position. Surrogacy is prohibited by law in Germany. Moreover, Jens Spahn, while serving as Minister of Health, repeatedly opposed its legalization. The Christian Democratic Union holds the same position. Additional questions arose from the fact that in February 2026, the CDU congress reaffirmed its rejection of surrogacy. Spahn participated in the adoption of this resolution, although it later emerged that at that time, the surrogate mother was already carrying a child for him and his spouse, Daniel Funke. The politician's statements from previous years also came back into focus. Back in 2015, in an interview with GQ magazine, Spahn admitted that as a gay man and a Christian, he found it difficult to accept the very idea of surrogacy, and becoming a father in such a way, he said, would be an extremely challenging decision. Later, in 2020, when the Free Democratic Party proposed to start discussions on the possible legalization of surrogacy, Spahn, who was then serving as Minister of Health, also publicly opposed this initiative. According to DPA, citing sources, Chancellor Friedrich Merz himself sought Spahn's resignation. At the same time, no legal consequences for the politician are expected. Although surrogacy is prohibited in Germany, such practice is legal in the United States, and German legislation does not prohibit raising a child born abroad through surrogacy. Thus, the reason for the resignation was not legal violations, but accusations of inconsistency and a mismatch between the publicly advocated principles and the politician's personal choices.
